The 125% Fee Guarantee – Terms & Conditions

1. Overview of the Guarantee

Autopraisal’s The 125% Fee Guarantee (“Guarantee”) is designed to provide confidence in the value of an independent appraisal. Under this Guarantee:

-  Express (non-Concierge services): if the documented and supported increased value attributable to Autopraisal’s appraisal does not meet or exceed 125% of the appraisal fee paid by the client;

-  Concierge: if the documented and supported increased value attributable to Autopraisal’s appraisal does not meet or exceed 125% the appraisal fee paid by the client, or Autopraisal is unable to reach a settlement amount that is equal to or more than the settlement offer plus 125% of the fee paid by the client;

Autopraisal will refund the appraisal fee, subject to the terms and conditions below.

        You pay $400 for an Autopraisal service.

        125% of $400 = $500

        That means Autopraisal’s work must help you gain at least $500 more than what the insurance company originally offered.

- All other services are performed as-is with out guarantee of recovery or minimum transaction amounts.


2. Eligibility Requirements

To qualify for the Guarantee, all of the following conditions must be met:

  • The appraisal must be paid.
  • The appraisal must be used for a total loss, diminished value, or related automotive valuation dispute.
  • The claim must be pursued in good faith with the insurer, responsible party, or opposing entity using the appraisal report as submitted.
  • The client must provide Autopraisal with all reasonably requested documentation, including settlement offers, payment breakdowns, photos, and correspondence.


3. Measurement of Value Increase

  • The “increase” is measured as the difference between the highest documented written offer prior to submission of the appraisal and the final determined value by Autopraisal.
  • Only direct monetary increases are considered. Non-monetary concessions (repairs, goodwill, policy changes, expedited handling, etc.) are excluded.
  • If no written offer existed prior to the appraisal, the pre-appraisal offer will be deemed $0.


4. Exclusions and Limitations

The Guarantee does not apply in the following circumstances:

  • The client accepts a settlement without presenting the appraisal or materially alters the appraisal conclusions.
  • The claim is abandoned, withdrawn, or settled before the appraisal can reasonably be reviewed.
  • The insurer or opposing party denies the claim for reasons unrelated to valuation (coverage denial, liability dispute, policy lapse, exclusions, or statute of limitations).
  • The client fails to cooperate, provide documentation, or follow reasonable guidance related to use of the appraisal.
  • The appraisal is used for litigation, arbitration, or appraisal clause proceedings unless expressly agreed to in writing.
  • Government entities, class actions, fleet claims, or commercial claims unless approved in advance.


5. Timeframe for Guarantee Claims

  • Any request under the Guarantee must be submitted within 30 days of the final settlement or written claim resolution.
  • Requests submitted after this period are void.


6. Refund Amount

  • The maximum refund under this Guarantee is limited to the appraisal fee actually paid.
  • Taxes, rush fees, inspection fees, and third-party costs are non-refundable unless required by law.
  • No additional damages, interest, or consequential losses are recoverable.


7. Required Documentation

To request a refund under the Guarantee, the client must submit (if not pre-determined by Autopraisal):

8. Professional Judgment Disclaimer

Autopraisal provides independent, USPAP-aligned opinions of value. The Guarantee does not promise a specific outcome, settlement amount, or insurer response. Claim outcomes depend on factors beyond valuation, including policy language, liability, jurisdiction, and insurer practices.


9. No Assignment or Transfer

The Guarantee applies only to the original client and may not be assigned or transferred.


10. Modification or Termination of Guarantee

Autopraisal reserves the right to modify or discontinue the Guarantee at any time. Any modification will apply prospectively and will not affect appraisals already completed and paid for.


11. Governing Law

This Guarantee and these Terms & Conditions are governed by the laws of the state in which the appraisal is performed, unless otherwise required by law.


12. Acceptance

Payment for and use of an Autopraisal appraisal constitutes acceptance of these Terms & Conditions.
